Why Same-Day Form 23 Matters for Property Sales
Under section 31 of the Building Act 1993 (Vic), settlement on a property with a pool or spa over 300 mm deep cannot complete without a current Form 23 attached to the Section 32 vendor statement. Your conveyancer cannot sign off without it. This isn’t a soft requirement — it’s statutory.
The compressed timeline emerges when:
- The vendor didn’t realise a Form 23 was required at sale
- The vendor’s existing Form 23 is more than 12 months old (conveyancers prefer recent)
- The previous Form 23 had non-conformance issues that weren’t addressed
- A pool was renovated after the existing certificate was issued
- Section 32 was prepared without the certificate and the buyer’s conveyancer just flagged it

The Same-Day Inspection Path

- Call 0402 860 499 first thing in the morning (before 9 AM if possible)
- Confirm property address, council, and pool registration status
- Inspector arrives same day, typically afternoon for early-morning bookings
- If barrier passes: Form 23 signed on-site, lodged electronically with council the same day
- Council-stamped copy emailed back within 3–7 business days (varies by council — Greater Geelong fastest at 3–5 days)

Settlement-Day Math: What’s Actually Achievable
7 days out (comfortable timeline if barrier passes)
Day 1: same-day inspection, Form 23 signed and lodged. Days 4–7: council stamps and emails the certified copy. Settlement: certified copy in hand.
If the barrier fails first inspection, you have 5–6 days for remediation and re-inspection. Possible only with the simpler fixes (spring replacement, NCZ trim, paving removal).
5 days out (tight, depends on council)
Greater Geelong (3-day council turnaround): doable on a clean pass.
Wyndham / Moorabool (5–7 day turnaround): tight even on a pass; risk of council not stamping in time.
3 days out (request settlement extension)
Even with same-day inspection and council lodgement, 3 days is generally too tight for the certified copy to come back. Talk to your conveyancer about a 7–14 day settlement extension. Settlement timeline detail.
What Same-Day Doesn’t Mean
Same-day refers to the inspection itself and the lodgement. The council-stamped copy is the document conveyancers want, and it takes 3–7 business days regardless of how quickly the inspector lodged. So “same-day Form 23” means:
- Same-day inspection ✓
- Same-day on-site signature ✓
- Same-day electronic lodgement to council ✓
- Council-stamped copy back: 3–7 business days from lodgement
If your conveyancer specifically needs the council-stamped copy in hand by settlement day, build in the council turnaround time.
Why $250 Doesn’t Have a Same-Day Surcharge
Some inspectors charge extra for same-day or after-hours bookings. We don’t. The $250 inc GST flat applies to:
- Booking 4 weeks ahead during a quiet period
- Same-day urgent settlement-week booking
- After-hours requests (where slots are available)
The reason: our model is built on dedicated same-day slots already in the daily schedule. Filling them isn’t an extra cost; it’s the regular operation. Some Melbourne operators charge $50–$150 same-day surcharges; we don’t.
Who Calls Us Same-Day Most Often
- Vendors mid-sale — discovered the certificate is needed days before settlement
- Conveyancers — escalating an urgent compliance gap on behalf of their client
- Real estate agents — the property is going to auction in 5 days and the certificate is missing
- Buyers post-settlement — moved in, realised the previous Form 23 was old, want a renewal before insuring
- Short-stay hosts — Airbnb or Stayz audit flagged compliance; short-stay compliance
- Estate executors — selling an inherited pool property; inherited property guidance
If You Fail Same-Day
If the barrier doesn’t pass first inspection, the Form 24 non-conformance report tells you exactly what to fix. Most fails are remediable in 1–2 days for the simplest issues:
- Replace gate spring (Bunnings, $30–$80, 15-min DIY)
- Trim NCZ plants (1 hour, hand pruning shears)
- Move pool pump out of NCZ (15 minutes)
- Remove built-up paving outside gate (half-day DIY)
